{"id":679,"date":"2011-09-09T18:45:52","date_gmt":"2011-09-09T18:45:52","guid":{"rendered":"http:\/\/scoresbyfamilylaw.com\/blog\/?p=679"},"modified":"2019-11-23T22:26:42","modified_gmt":"2019-11-24T05:26:42","slug":"post-trial-proceedings-in-divorce-cases","status":"publish","type":"post","link":"http:\/\/scoresbyfamilylaw.com\/blog\/2011\/09\/09\/post-trial-proceedings-in-divorce-cases\/","title":{"rendered":"Post-Trial Proceedings in Divorce Cases"},"content":{"rendered":"<p><a href=\"http:\/\/scoresbyfamilylaw.com\/blog\/wp-content\/uploads\/thumbnailCADHX0N8.jpg\"><img decoding=\"async\" class=\"alignleft size-full wp-image-754\" title=\"thumbnailCADHX0N8\" alt=\"\" src=\"http:\/\/scoresbyfamilylaw.com\/blog\/wp-content\/uploads\/thumbnailCADHX0N8.jpg\" width=\"300\" height=\"225\" \/><\/a>Divorce cases sometimes\u00a0seem to drag on forever.\u00a0 When\u00a0a case doesn&#8217;t settle, it can take a year or longer to get from the start of the case to the court trial.\u00a0 When a case finally goes to court, husband and wife\u00a0naturally think that is the end of their case.\u00a0 Wrong!\u00a0 In most cases, the judge does <em>not<\/em> rule at the time of trial.\u00a0 The judge takes the matter &#8220;under advisement&#8221; and issues a written ruling at a later date.\u00a0 Weeks or months can pass after the divorce court trial before husband and wife are finally actually divorced.<\/p>\n<p>In addition, in some divorce cases, especially those that are complicated and hotly contested, there can be significant work left to do after the\u00a0court trial.\u00a0 I recently had a divorce case involving children that went to trial.\u00a0 At the conclusion of the trial, the judge asked both lawyers to submit proposed divorce decrees to the court via email in Microsoft Word format, presumably for the judge&#8217;s use in crafting his final orders.\u00a0 Preparing these proposed decrees took considerable time for the lawyers to do\u00a0and was a considerable expense for both parties.<!--more--><\/p>\n<p>Approximately one month after the trial, the judge issued a written ruling, but the ruling contained at least one error and one omission\u00a0that needed to be corrected.\u00a0 As a result, I filed a post-trial motion under Rule 84 of the Arizona Rules of Family Law Procedure (ARFLP) asking the court to alter and amend the judgment to correct the errors.\u00a0 I am anticipating that the other lawyer will oppose at least part of my motion, so again, there will be\u00a0fees charged to the parties for this time and work.<\/p>\n<p>In addition to a motion to alter or amend\u00a0a \u00a0judgment, other post-trial motions that may be filed include a motion for a new trial (Rule 83, ARFLP), a motion for reconsideration (Rule 35 D, ARFLP), and a motion to set aside the ruling (Rule 85 C, ARFLP).\u00a0 Furthermore, if a trial ruling is appealed to the Arizona Court of Appeals, the appeals process can take up to a year or longer to complete.\u00a0 Some appeals are followed by additional proceedings in the trial court as directed by the Court of Appeals.<\/p>\n<p>Once\u00a0the trial \u00a0judge signs a decree\/order dissolving the parties&#8217; marriage, the husband and wife are divorced.\u00a0 The post-trial proceedings will not affect the parties&#8217;\u00a0marital status but do prolong the agony in other ways (financial expense, aggravation, etc).\u00a0\u00a0 To avoid these post-trial processes, husband and wife should attempt to settle all the issues between themselves and not leave anything for the court to decide.\u00a0 Obviously if both parties consent to the terms of the divorce decree and prepare the divorce decree themselves, neither should feel the need to <em>fix<\/em> the decree after it is signed by the judge.\u00a0 Child custody, child support and sometimes spousal support continue to be modifiable by the trial judge at a later time if\/when circumstances change.<\/p>\n<p>Copyright \u00a9 2011 by Scoresby Family Law \u2013 J.
