{"id":885,"date":"2011-11-01T22:22:39","date_gmt":"2011-11-01T22:22:39","guid":{"rendered":"http:\/\/scoresbyfamilylaw.com\/blog\/?p=885"},"modified":"2019-11-23T22:26:41","modified_gmt":"2019-11-24T05:26:41","slug":"step-parent-visitation","status":"publish","type":"post","link":"http:\/\/scoresbyfamilylaw.com\/blog\/2011\/11\/01\/step-parent-visitation\/","title":{"rendered":"Step-parent Visitation"},"content":{"rendered":"<p><img decoding=\"async\" class=\"alignleft size-full wp-image-892\" title=\"thumbnailCA35H0RI\" alt=\"\" src=\"http:\/\/scoresbyfamilylaw.com\/blog\/wp-content\/uploads\/thumbnailCA35H0RI.jpg\" width=\"300\" height=\"214\" \/>In today&#8217;s society, blended families are the norm.\u00a0 In some families, children grow to be closer to their step-fathers than to their biological fathers.\u00a0 When a parent and a step-parent divorce, step-parents are able to seek visitation rights in most cases.<\/p>\n<p>The law provides that a person who stands <em>in loco parentis <\/em>to a child may be awarded visitation rights if the visitation is in the child&#8217;s best interests <strong>and<\/strong> provided that one of the following is true:<\/p>\n<p>1) One of the legal parents is deceased or has been missing at least three months.<\/p>\n<p>2) The child&#8217;s legal parents are not married to each other at the time the petition is filed.<\/p>\n<p>3) There is a pending proceeding for dissolution of marriage or for legal separation of the legal parents at the time the petition is filed.<!--more--><\/p>\n<p>A.R.S. Sec. 25-415 (C).<\/p>\n<p>A person stands <em>in loco parentis<\/em> to a child if the person has been treated as a parent by the child and has formed a meaningful parental relationship with the child for a substantial period of time.\u00a0 A.R.S. Sec. 25-415 (G)(1).<\/p>\n<p>The step-parent (or other<em>\u00a0in loco parentis<\/em> person) files\u00a0his petition for\u00a0visitation in the same action in which a previous custody order has been entered regarding the child.\u00a0 The action in which the previous custody order was entered \u00a0is\u00a0the divorce or paternity\u00a0case between the legal parents (usually the biological mother and father).\u00a0\u00a0 A.R.S. Sec. 25-415 (F).\u00a0 In the step-parent visitation case, both of the legal parents are opposing parties, and the petition must be served on both\u00a0legal parents.\u00a0\u00a0 If there is no prior custody\u00a0order, such as when\u00a0the mother was never married to the father and paternity was never established, the step-father may file a new action against both the mother and the man believed to be the father.<\/p>\n<p>Although step-parents may seek visitation rights under A.R.S. Sec. 25-415 under appropriate circumstances as outlined above, step-parents have no legal obligation to financially support their step-children, and they cannot be ordered to pay child support.<\/p>\n<p>Copyright \u00a9 2011 by Scoresby Family Law \u2013 J.
