{"id":1085,"date":"2011-12-01T03:39:10","date_gmt":"2011-12-01T03:39:10","guid":{"rendered":"http:\/\/scoresbyfamilylaw.com\/blog\/?p=1085"},"modified":"2019-11-23T22:26:41","modified_gmt":"2019-11-24T05:26:41","slug":"kim-kardashian-vs-kris-humphries-divorce-or-annulment","status":"publish","type":"post","link":"https:\/\/scoresbyfamilylaw.com\/blog\/2011\/12\/01\/kim-kardashian-vs-kris-humphries-divorce-or-annulment\/","title":{"rendered":"Kim Kardashian vs. Kris Humphries: Divorce or Annulment?"},"content":{"rendered":"<p><a href=\"http:\/\/scoresbyfamilylaw.com\/blog\/wp-content\/uploads\/reg_1024_kk_kiss_ls_0825111.jpg\"><img decoding=\"async\" class=\"alignleft size-full wp-image-1149\" title=\"reg_1024_kk_kiss_ls_082511\" alt=\"\" src=\"http:\/\/scoresbyfamilylaw.com\/blog\/wp-content\/uploads\/reg_1024_kk_kiss_ls_0825111.jpg\" width=\"90\" height=\"90\" srcset=\"https:\/\/scoresbyfamilylaw.com\/blog\/wp-content\/uploads\/reg_1024_kk_kiss_ls_0825111-66x66.jpg 66w, https:\/\/scoresbyfamilylaw.com\/blog\/wp-content\/uploads\/reg_1024_kk_kiss_ls_0825111.jpg 90w\" sizes=\"(max-width: 90px) 100vw, 90px\" \/><\/a>Will\u00a0Kim Kardashian and Kris Humphries get a divorce or an annulment?\u00a0 What&#8217;s the difference?\u00a0 Do they have a choice?\u00a0 What are the advantages and disadvantages of each?\u00a0 Who cares?\u00a0 Although I couldn&#8217;t care less about the Kardashian-Humphries saga, their\u00a0marital relationship\u00a0and its termination are a useful backdrop for a discussion of the differences between dissolution of marriage (divorce) and annulment of marriage.<!--more--><\/p>\n<p>Annulments are rare in Arizona, largely because a person must prove <em>grounds<\/em> to qualify for an annulment.\u00a0 With most Arizona divorces, by contrast, a person need only show that <strong>in her own mind<\/strong> the marriage is irretrievably broken, whether her spouse feels the same way or not.\u00a0\u00a0\u00a0A person who qualifies for an annulment may choose to pursue a divorce instead, but a person who qualifies to get a divorce can only choose an annulment instead if there are legal grounds for\u00a0an annulment.<\/p>\n<p>Grounds exist for an annulment where some impediment renders the marriage void or voidable.\u00a0 A.R.S. Section 25-301.\u00a0 An example of a clearly voidable marriage is the case of a woman who marries a man and later discovers that, at the time of the marriage, her husband was married to another woman.\u00a0\u00a0The man&#8217;s second wife would be entitled to an annulment of the second (bigamous) marriage.<\/p>\n<p>Other cases may qualify for annulment, but they are less clear.\u00a0\u00a0 Material, fraudulent misrepresentations made to induce the marriage <em>may<\/em> constitute grounds for annulment.\u00a0 If a man misrepresents his religious affiliation and that misrepresentation is a key factor the wife relies on in deciding to enter the marriage, the wife is probably entitled to an annulment based on that misrepresentation.\u00a0 <em>State Compensation Fund v. Foughty and Industrial Commission<\/em>, 476 P.2d 902, 13 Ariz.App. 381 (Ariz. App. 1970). \u00a0Misrepresenting one&#8217;s financial situation, however, is probably not sufficient grounds.\u00a0 <em>State Compensation Fund v. Reed<\/em>, 470 P.2d 465, 12 Ariz.App. 317 (Ariz. App. 1970).\u00a0\u00a0 Impotency or the failure to consummate the marriage alone is NOT a basis for an annulment.\u00a0 <em>Jackson v. Industrial Commission<\/em>, 592 P.2d 1258, 1260, 121 Ariz. 602 (Ariz. 1979) (citations omitted).<\/p>\n<p>Depending on the facts he was able to prove in court, perhaps a Kris Humphries could seek an annulment based on fraudulent misrepresentations by his\u00a0Kim Kardashian.\u00a0 From the lawyer&#8217;s perspective, however, the question is usually not simply <em>whether<\/em> my client (or the opposing party)\u00a0may qualify for an annulment.\u00a0 The real question is, &#8220;if my client qualifies for\u00a0or successfully opposes an annulment, what will the financial effect be on my client?&#8221;<\/p>\n<p>A divorce dissolves a valid marriage as of the date of the divorce decree.\u00a0 In the absence of a premarital agreement, community property law applies.\u00a0 An annulment, on the other hand, &#8220;invalidates a marriage from its inception, thereby establishing that the marital status never existed.&#8221;\u00a0 <em>State ex rel. Dept. of Economic Security v. Demetz<\/em>, 130 P.3d 986, 988, 212 Ariz. 287 (Ariz. App. 2006) (citations omitted).\u00a0\u00a0Since the annulment invalidates the marriage from its inception,\u00a0the annulment\u00a0also negates community property.\u00a0 Suddenly, what&#8217;s yours really is yours and what&#8217;s mine really is mine, not &#8220;ours.&#8221;<\/p>\n<p>Consider this extreme example for sake of illustration.\u00a0 Husband and Wife marry without a prenuptial agreement.\u00a0 Three weeks later, Wife cashes her paycheck, buys a lottery ticket, and the ticket is a winner.\u00a0 Wife decides to dump Husband.\u00a0 If Wife qualifies for an annulment, Husband gets none of the lottery winnings.\u00a0 If Husband and Wife divorce, however, the lottery winnings are community\u00a0property, and\u00a0Husband gets half.\u00a0 Wife will pursue the annulment if she believes plausible grounds exist, and Husband will strenuously oppose it.\u00a0 In short, Although some people seek an annulment simply because they feel better not having to say they were divorced, the primary basis for seeking an annulment rather than a divorce is often financial.<\/p>\n<p>If you believe you may qualify for an annulment and are considering an annulment in lieu of a divorce, I would welcome the opportunity to meet with you to discuss the facts of your particular case.<\/p>\n<p>Copyright \u00a9 2011 by Scoresby Family Law \u2013 J.
