{"id":1238,"date":"2012-03-16T22:24:31","date_gmt":"2012-03-16T22:24:31","guid":{"rendered":"http:\/\/scoresbyfamilylaw.com\/blog\/?p=1238"},"modified":"2016-02-26T13:25:08","modified_gmt":"2016-02-26T20:25:08","slug":"new-arizona-bill-would-expand-fathers-rights","status":"publish","type":"post","link":"https:\/\/scoresbyfamilylaw.com\/blog\/2012\/03\/16\/new-arizona-bill-would-expand-fathers-rights\/","title":{"rendered":"New Arizona Bill Would Expand Fathers&#039; Rights"},"content":{"rendered":"<p>My series on the divorce process will resume next week with a post about serving the initial divorce papers after they are filed with the court.\u00a0 For this week, however, I wanted to address a new development at the Arizona Legislature.<\/p>\n<p>Under current Arizona law, married fathers have rights to their children which are equal to\u00a0mothers&#8217; rights until courts make specific custody and parenting time\u00a0orders.\u00a0 Fathers of children born out of wedlock, however, have virtually no rights until a court awards the father child custody\/parenting time by court order.\u00a0 Under A.R.S. Section 13-1302, the mother is the legal custodian of a child born out of wedlock until the court orders otherwise.<\/p>\n<p>If AZ Senate Bill 1492 becomes law,\u00a0 fathers of out-of-wedlock children will be put on equal ground with the children&#8217;s mothers even prior to court orders being entered.\u00a0 This bill passed the Arizona Senate on March 8, 2012, and now goes to vote in the Arizona House.\u00a0\u00a0 Here is a link to the full text of the bill:\u00a0\u00a0<a href=\"http:\/\/e-lobbyist.com\/gaits\/text\/557146\">http:\/\/e-lobbyist.com\/gaits\/text\/557146<\/a>.\u00a0 \u00a0I intend to follow up on this bill and will bring you new developments as they become available.<\/p>\n<p>Copyright \u00a9 2012 by Scoresby Family Law \u2013 J.
