{"id":1371,"date":"2012-06-06T21:09:14","date_gmt":"2012-06-06T21:09:14","guid":{"rendered":"http:\/\/scoresbyfamilylaw.com\/blog\/?p=1371"},"modified":"2019-11-23T22:26:38","modified_gmt":"2019-11-24T05:26:38","slug":"californias-prop-8-gay-marriage-case-likely-to-go-to-u-s-supreme-court","status":"publish","type":"post","link":"https:\/\/scoresbyfamilylaw.com\/blog\/2012\/06\/06\/californias-prop-8-gay-marriage-case-likely-to-go-to-u-s-supreme-court\/","title":{"rendered":"California&#039;s Prop 8 Gay Marriage Case Likely to go to U.S. Supreme Court"},"content":{"rendered":"<p>In February of this year, the 9th Circuit U.S. Court of Appeals affirmed a U.S. District Judge&#8217;s ruling that California&#8217;s Proposition 8 banning gay marriage was unconstitutional.\u00a0 On Tuesday, June 5, 2012, the 9th Circuit refused to reconsider its February ruling.\u00a0 Supporters of Prop 8 will now petition the U.S. Supreme Court to review the 9th Circuit&#8217;s ruling.\u00a0 Prop 8 remains in effect in California for now and gay marriages will not be lawful there pending resolution of the Supreme Court appeal.<\/p>\n<p>If the Supreme Court declines review, the 9th Circuit&#8217;s ruling will stand, Prop 8 will be invalidated, and gay marriage will again be legal in California.\u00a0 If the Supreme Court accepts review, Prop 8 will remain in effect until the Supreme Court renders its decision.<\/p>\n<p>As reported\u00a0by the Associated Press on Tuesday, June 5, 2012, a Massachusetts case involving similar issues may reach the Supreme Court at the same time as the Prop 8 case, which may increase the likelihood that the Court will accept review.\u00a0 On the other hand, &#8220;because the 9th Circuit limited its decision <div class=\"fusion-fullwidth fullwidth-box fusion-builder-row-1 hundred-percent-fullwidth non-hundred-percent-height-scrolling\" style=\"--awb-border-radius-top-left:0px;--awb-border-radius-top-right:0px;--awb-border-radius-bottom-right:0px;--awb-border-radius-bottom-left:0px;--awb-overflow:visible;--awb-flex-wrap:wrap;\" ><div class=\"fusion-builder-row fusion-row\"><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-0 fusion_builder_column_1_1 1_1 fusion-one-full fusion-column-first fusion-column-last fusion-column-no-min-height\" style=\"--awb-bg-size:cover;--awb-margin-bottom:0px;\"><div class=\"fusion-column-wrapper fusion-flex-column-wrapper-legacy\">[in the Prop 8 case] to California instead of ruling that gay-marriage bans are inherently unconstitutional, the Supreme Court might be inclined to let it stand . . . .&#8221;\u00a0 <em>Associated Press, June 5, 2012.<\/em>\u00a0\u00a0 To read the complete\u00a0AP article, click on the following link:\u00a0\u00a0\u00a0<a title=\"AP Prop 8 Article\" href=\"http:\/\/hosted2.ap.org\/CARIE\/6b85546689744819aa7a64cd3ca6cee6\/Article_2012-06-05-Gay%20Marriage%20Trial\/id-3515b968fc5d45318a1458352e080e4d\">http:\/\/hosted2.ap.org\/CARIE\/6b85546689744819aa7a64cd3ca6cee6\/Article_2012-06-05-Gay%20Marriage%20Trial\/id-3515b968fc5d45318a1458352e080e4d<\/a><\/p>\n<p>Of course, I will continue to monitor this issue and will post news updates on the gay marriage cases they progress through the legal system.<\/p>\n<p>Copyright \u00a9 2012 by Scoresby Family Law \u2013 J.
