{"id":1549,"date":"2013-03-04T13:02:57","date_gmt":"2013-03-04T20:02:57","guid":{"rendered":"http:\/\/scoresbyfamilylaw.com\/blog\/?p=1549"},"modified":"2019-11-23T22:26:38","modified_gmt":"2019-11-24T05:26:38","slug":"unequal-division-of-real-estate-affirmed-on-appeal","status":"publish","type":"post","link":"https:\/\/scoresbyfamilylaw.com\/blog\/2013\/03\/04\/unequal-division-of-real-estate-affirmed-on-appeal\/","title":{"rendered":"Unequal Division of Real Estate Affirmed on Appeal"},"content":{"rendered":"<p>About 18 months ago, I posted about a divorce case of mine in which we went to trial and won significantly more than 50% of the jointly titled real estate for my client. \u00a0<em>See\u00a0<a title=\"open the article\" href=\"http:\/\/scoresbyfamilylaw.com\/reference\/?p=648\" target=\"_blank\" rel=\"noopener noreferrer\">Equitable but Unequal Division of\u00a0 Real Estate in Divorce\u00a0<\/a><\/em>\u00a09\/2\/11.<!--more--><\/p>\n<p>Unhappy with the ruling, the wife appealed. \u00a0A few weeks ago, I learned that the Court of Appeals affirmed the trial court&#8217;s ruling awarding the real estate to my former client, the husband.\u00a0\u00a0To read the Court of Appeals&#8217; decision click here:\u00a0<em><a href=\"http:\/\/scoresbyfamilylaw.com\/blog\/wp-content\/uploads\/13.0304.Appeal.pdf\">Appeal<\/a>.<\/em><\/p>\n<p>This was a huge win for my former client. \u00a0The only downside is that the ruling is a\u00a0<em>memorandum decision<\/em>, which means it may not be cited as precedent in other cases. \u00a0In other words, it doesn&#8217;t created any new Arizona law. \u00a0It is a great case for my former client, but no other lawyers will be able to rely on this ruling to argue for similar results for their clients.<\/p>\n<p>This ruling is another reminder to me that sometimes the only way to find out whether you can win an issue is to take it to trial. \u00a0You may try the case and lose, but if you fail to try the case, you lose <em>for sure<\/em>. \u00a0Try the case, and you may succeed.<\/p>\n<p>Copyright \u00a9 2013 by Scoresby Family Law \u2013 J.
