{"id":2925,"date":"2016-04-19T10:41:05","date_gmt":"2016-04-19T17:41:05","guid":{"rendered":"http:\/\/scoresbyfamilylaw.com\/blog\/?p=2925"},"modified":"2020-12-15T10:13:20","modified_gmt":"2020-12-15T17:13:20","slug":"temporary-orders-in-divorce-litigation","status":"publish","type":"post","link":"https:\/\/scoresbyfamilylaw.com\/blog\/2016\/04\/19\/temporary-orders-in-divorce-litigation\/","title":{"rendered":"Temporary Orders in Divorce Litigation"},"content":{"rendered":"<p>A contested divorce case in Arizona can take over a year to complete.\u00a0 While the case is pending, one spouse often needs financial support from the other.\u00a0 Waiting until the divorce is final to get spousal maintenance or child support may be simply impossible.<\/p>\n<p>Likewise, in cases involving children, waiting up to a year or more to secure a final divorce decree and parenting plan establishing decision-making and parenting time may leave one parent feeling that he or she has been cut out of the children\u2019s lives entirely.<\/p>\n<p>Under Arizona Revised Statutes, Sections 25-315 and 25-404, Arizona courts have authority to enter <em>temporary orders<\/em> establishing child legal decision-making and parenting time and awarding financial support while a divorce case is pending.\u00a0 These temporary orders remain in force until they are modified by the court or until they terminate due to a final divorce decree being entered or due to the dismissal of the case.<\/p>\n<p>In addition to establishing temporary legal decision-making, parenting time and support orders, a court may use temporary orders to award one spouse temporary exclusive use of a marital home.\u00a0 A court may award temporary exclusive possession of vehicles and other items of personal property, and a court may even order which spouse is to make the mortgage and other debt payments while the case is pending.<\/p>\n<p>When a couple has checking, savings or other cash accounts, either party may file a motion under A.R.S. Section 25-315.B. asking the court to award \u201cequal possession of the liquid assets.&#8221; \u00a0When such a motion is filed, the statute requires that \u201c<div class=\"fusion-fullwidth fullwidth-box fusion-builder-row-1 hundred-percent-fullwidth non-hundred-percent-height-scrolling\" style=\"--awb-border-radius-top-left:0px;--awb-border-radius-top-right:0px;--awb-border-radius-bottom-right:0px;--awb-border-radius-bottom-left:0px;--awb-overflow:visible;--awb-flex-wrap:wrap;\" ><div class=\"fusion-builder-row fusion-row\"><div class=\"fusion-layout-column fusion_builder_column fusion-builder-column-0 fusion_builder_column_1_1 1_1 fusion-one-full fusion-column-first fusion-column-last fusion-column-no-min-height\" style=\"--awb-bg-size:cover;--awb-margin-bottom:0px;\"><div class=\"fusion-column-wrapper fusion-flex-column-wrapper-legacy\">[t]he court <strong><em>shall<\/em><\/strong> provide for an order for equal possession of the liquid assets of the marital property that existed as of the date the petition . . . was served, unless the court finds that there is good cause not to divide those assets.\u201d\u00a0 <em>Emphasis added.<\/em><\/p>\n<p>Keep in mind that temporary orders are just that\u2014a <em>temporary<\/em> resolution. \u00a0They do not create a <em>final <\/em>resolution of any issue.\u00a0 When a case doesn\u2019t settle, a judge must still hold a court trial to hear evidence and make a\u00a0 <em>final<\/em> disposition of these issues.\u00a0 Temporary orders are <em>without prejudice, <\/em>meaning that neither the parties nor the court are bound by those orders at trial.\u00a0 Each spouse may argue for a different result at trial, and the judge is authorized to make any final orders she deems appropriate based on the evidence presented at the divorce trial.<\/p>\n<p>Divorce litigation can be very expensive, and establishing temporary orders is no exception.\u00a0 A temporary orders evidentiary hearing is like a mini court trial.\u00a0 The same basic procedure and rules apply at a temporary orders hearing as at a final trial.\u00a0 Significant preparation is required.\u00a0 Testimony is allowed, witnesses are called, and exhibits are presented.<\/p>\n<p>How quickly a judge can set a hearing on a motion for temporary orders depends on the time needed for the hearing and on the judge\u2019s calendar and availability.\u00a0 When a final trial date can be scheduled only two or three months after a temporary orders hearing date, it may not make sense financially to spend attorney\u2019s fees to pursue temporary orders.\u00a0 For example, if the final trial date can be scheduled in the month of April, it doesn\u2019t make sense to spend $3,000.00 on attorney\u2019s fees in the month of February to obtain support of $1,000.00 per month for the two months until trial.<\/p>\n<p>It is always preferable for spouses to <em>agree<\/em> on temporary child legal decision-making, parenting time, support and other matters.\u00a0 When agreements cannot be reached, however, a motion for temporary orders may be necessary. \u00a0An experienced family law attorney can \u00a0advise his client as to whether filing for temporary orders is in the client\u2019s best interests.<\/p>\n<p>Copyright \u00a9 2016, 2020 by Scoresby Family Law \u2013 J.
