assets. \u00a0The process of dividing assets in divorce consists of\u00a0<strong>identifying<\/strong>\u00a0the assets,\u00a0<strong>categorizing\u00a0<\/strong>the assets as separate or community property,\u00a0<strong>valuing<\/strong> the assets, and\u00a0<strong>dividing\u00a0<\/strong>the community property assets substantially equally.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Identifying the Assets<\/strong><\/span>. \u00a0Before assets can be divided in a divorce, we must know\u00a0<em>what\u00a0<\/em>assets the parties have. \u00a0A lawyer&#8217;s best source of this information is typically his own <em>client<\/em>. \u00a0I have my clients provide me lists or inventories of all of their assets, including real estate, vehicles, businesses, retirement and investment accounts, and household goods.<\/p>\n<p><em>Tax returns<\/em> are also rich sources of information. \u00a0The dividends and interest reported on Schedule B to the Federal 1040 tax return form may lead to the discovery of previously-unknown bank or brokerage accounts. \u00a0Other schedules may reveal real estate holdings or business interests.<\/p>\n<p>Another way to identify assets is a <em>discovery or information request<\/em>\u00a0to the opposing party. \u00a0 Discovery tools include written questions, called &#8220;interrogatories&#8221;, \u00a0requests for production of documents, and depositions.<\/p>\n<p>Finally,<em>\u00a0<\/em>a lawyer may\u00a0<em>subpoena\u00a0<\/em>information about assets from financial institutions and other third parties.<\/p>\n<p><strong><span style=\"text-decoration: underline;\">Categorizing the Assets<\/span><\/strong>. \u00a0Once we know what assets exist, we must categorize them as <em>community property<\/em> or <em>sole and separate property<\/em>. \u00a0Only community property is divisible in a divorce. \u00a0Community property includes, essentially, every asset acquired by either spouse&#8217;s industry during the marriage. \u00a0Sole and separate property includes assets either spouse brought into the marriage and assets gifted to or inherited by a spouse during the marriage.<\/p>\n<p>The existence of a prenuptial agreement would also affect whether assets are community or separate.<\/p>\n<p>Some assets may be mixed, such as a 401(k) one spouse brought into the marriage but to which that spouse continued contributing during the marriage. \u00a0The pre-marriage balance (and during-marriage growth thereon) is separate property. \u00a0The during-marriage contributions and growth thereon is community property.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Valuing the Community Assets<\/strong><\/span><strong>. \u00a0\u00a0<\/strong>The assets identified and categorized as community property must next be <em>valued<\/em>. \u00a0The values of bank and other financial accounts are determined by <em>statements<\/em>.<\/p>\n<p>Vehicles are typically valued using the <em>Kelly Blue Book<\/em>.<\/p>\n<p>Real estate and business interests may need to be <em>appraised<\/em>. \u00a0Unique assets such as jewelry, fine art, or collections may also need to be appraised by an industry specialist.<\/p>\n<p><span style=\"text-decoration: underline;\"><strong>Dividing the Community Assets<\/strong><\/span>. \u00a0Finally, once the community assets are identified and valued, they must be divided between the spouses. \u00a0 The division can by made by the judge following a court trial or can occur by way of a settlement agreement reached by the parties with or without a mediator.<\/p>\n<p>Under Arizona law, community property is to be divided &#8220;equitably&#8221;, which has been interpreted by the courts to mean substantially equally. \u00a0In rare cases, however, a judge has the discretion to find that the <em>equitable<\/em>\u00a0division is unequal. \u00a0This might be appropriate when one spouse uses separate property to purchase a jointly-titled home in the first few weeks of a marriage and when the marriage ends very shortly thereafter. \u00a0The judge may not feel it is fair&#8211;not equitable&#8211;to award the\u00a0non-contributing spouse 50% of the jointly-titled home when the marriage never really took hold.<\/p>\n<p>Additionally, &#8220;marital misconduct&#8221;, such as an extra-marital affair, is not to be considered by a judge in dividing marital assets. \u00a0 Where one spouse has destroyed, concealed, or fraudulently disposed of assets, however, it may be possible for the &#8220;innocent&#8221; spouse to obtain an unequal division of the remaining marital assets to compensate her for the &#8220;guilty&#8221; spouse&#8217;s waste of marital assets.<\/p>\n<div class=\"post-content\">\n<div class=\"post-content\">\n<p>Copyright \u00a9 2017 by Scoresby Family Law \u2013 J.
