{"id":508,"date":"2011-08-09T22:45:46","date_gmt":"2011-08-09T22:45:46","guid":{"rendered":"http:\/\/scoresbyfamilylaw.com\/blog\/?p=508"},"modified":"2019-11-23T22:26:42","modified_gmt":"2019-11-24T05:26:42","slug":"school-choice-fight-on-the-playground","status":"publish","type":"post","link":"https:\/\/scoresbyfamilylaw.com\/blog\/2011\/08\/09\/school-choice-fight-on-the-playground\/","title":{"rendered":"School Choice: Fight on the playground!"},"content":{"rendered":"<p><a href=\"http:\/\/scoresbyfamilylaw.com\/blog\/wp-content\/uploads\/thumbnailCALU32BY.jpg\"><img decoding=\"async\" class=\"alignright size-full wp-image-664\" title=\"thumbnailCALU32BY\" alt=\"\" src=\"http:\/\/scoresbyfamilylaw.com\/blog\/wp-content\/uploads\/thumbnailCALU32BY.jpg\" width=\"269\" height=\"192\" \/><\/a>Most Phoenix-area kids head back to school this week, but to which school?\u00a0 The one by dad&#8217;s house or the one by mom&#8217;s house?\u00a0 Determining which school children will attend following divorce or separation is a\u00a0common\u00a0issue without an easy solution.<\/p>\n<p>Ours is a highly mobile society, and\u00a0relocations within a metropolitan area are even more commonplace than out-of-state relocations.\u00a0 When parents move away from\u00a0the schools their children have been attending, a school change is\u00a0often needed either due to school district guidelines (e.g., when the district does not allow open enrollment or a boundary exception) or simply due to the impracticality of transporting the children to their former school.<!--more--><\/p>\n<p>Although it is best for the parents to confer and agree on\u00a0where their children will go to school, school choice is an issue that\u00a0sometimes devolves into a heated fight between the parents.\u00a0 Family court judges\u00a0are\u00a0inundated with motions during the summer months by parents seeking\u00a0 judicial determinations as to where their children will attend school the following school year.<\/p>\n<p>As with any child-related decision a judge is called upon to make, the judge&#8217;s foremost concern will be the children&#8217;s best interests.\u00a0 If one parent continues to reside within the school boundaries from which the other parent has moved away, the stability gained by keeping the child in the same\u00a0school he attended last year will be strong evidence <strong>against<\/strong> changing schools.\u00a0\u00a0 A judge\u00a0will also consider evidence of the\u00a0two competing schools&#8217; performance on standardized tests, such as AIMS.\u00a0\u00a0 In certain cases, the judge may even consider the child&#8217;s wishes.\u00a0 After\u00a0hearing and evaluating\u00a0all relevant evidence, the judge will order that the child attend the school the judge believes best\u00a0serves\u00a0the child&#8217;s best interests.<\/p>\n<p>Parents are advised to address school choice issues well in advance of the school year &#8212; probably at least six\u00a0months in advance.\u00a0 Many school choice\u00a0disputes can be resolved with the assistance of a good mediator, without the need to go to court.\u00a0 When a judicial determination is required, however, it may depending on circumstances take anywhere from a few days to several months to obtain a hearing and the judge&#8217;s decision.\u00a0 Parents shouldn&#8217;t count on getting a decision before school starts if they wait until only a few days or weeks before the start of the school year to raise the issue with the judge.<\/p>\n<p>Copyright \u00a9 2011 by Scoresby Family Law \u2013 J.
