{"id":770,"date":"2011-09-30T00:54:37","date_gmt":"2011-09-30T00:54:37","guid":{"rendered":"http:\/\/scoresbyfamilylaw.com\/blog\/?p=770"},"modified":"2019-11-23T22:26:42","modified_gmt":"2019-11-24T05:26:42","slug":"motions-to-compel-disclosure-and-discovery","status":"publish","type":"post","link":"https:\/\/scoresbyfamilylaw.com\/blog\/2011\/09\/30\/motions-to-compel-disclosure-and-discovery\/","title":{"rendered":"Motions to Compel Disclosure and Discovery"},"content":{"rendered":"<p>After a divorce or other family law case is filed, both parties are required to disclose certain relevant information and documents.\u00a0 <em>See <\/em>Rule 49, Arizona Rules of Family Law Procedure (ARFLP).\u00a0 In addition to the minimum disclosures which each party is required to make and entitled to receive from the other, the parties may seek additional information and documents using the <em>discovery<\/em> tools outlined in Rules 51 &#8211; 64, ARFLP.\u00a0 These tools include requests for written responses to certain questions, called &#8220;interrogatories&#8221;, and requests to produce documents.<!--more--><\/p>\n<p>Shockingly, sometimes one\u00a0party is reluctant to provide the information and documents requested by his spouse.\u00a0 This failure to cooperate in providing needed information can bring a case to a standstill.\u00a0 Consider\u00a0the situtation\u00a0where the husband owns and operates a business which is a marital asset.\u00a0 In order to determine the value of the business for purposes of a divorce\u00a0settlement conference and\/or trial, wife needs to have the business appraised.\u00a0 Wife serves husband with a request for the documents (business financial statements, tax returns, etc.) which are required by the appraiser, but husband refuses to provide the documents.\u00a0 Wife is unable\u00a0to\u00a0proceed with the appraisal and is prevented from adequately preparing for trial due to\u00a0husband&#8217;s refusal to cooperate.\u00a0 What is wife&#8217;s remedy?<\/p>\n<p>Fortunately,\u00a0Rule 65 ARFLP provides that if\u00a0one party fails to make disclosure or respond to discovery requests, the aggrieved party may file a motion with the court\u00a0to compel the disclosure or discovery responses.\u00a0 Along with the motion, the moving party\/lawyer must file a separate written statement outlining how, &#8220;after personal consultation and good faith efforts to do so, counsel have not been able to satisfactorily resolve the matter.&#8221;\u00a0 Rule 65 (A)(1)(c), ARFLP.\u00a0 If the court finds the motion to compel has merit, the court will order the non-compliant party to provide the requested information by a date certain\u00a0and will often impose a sanction, such as ordering the non-compliant party to pay the moving party&#8217;s attorney&#8217;s fees.\u00a0\u00a0 If the non-compliant party still refuses to comply, the court may impose more serious sanctions, including proceeding by default against the non-compliant party.\u00a0 Rule 65 (B), ARFLP.<\/p>\n<p>Copyright \u00a9 2011 by Scoresby Family Law \u2013 J.
