A separate issue from parenting time is legal custody of the child, which is the authority to participate in decisions about things like education, health care and religious upbringing. Barring serious substance abuse or domestic violence concerns, legal custody is usually shared jointly.

Many legal custody orders and settlements include mechanisms for resolving disputes, such as mediation or the involvement of a psychologist or other expert as a parenting coordinator. This can be a good way to prevent parents and children from returning to court repeatedly.
